1. Contracting party and acceptance
Wesal is the public brand operated by SADEQ HUSSEIN SALEH ALOTUMI. By accessing or using the website, onboarding flow, dashboard, support channels, or messaging tools of Wesal, you agree to these Terms of Service.
If you use the service on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms. If you do not agree, you must not use the service.
2. Account registration and requirements
- The service is intended for business and commercial use only.
- You must be legally capable of entering into a binding agreement under the laws that apply to you.
- You must provide accurate, current, and complete business identity and contact information, and keep it updated.
- You may not use the service in a way that impersonates another person, company, or brand.
3. Service description
Wesal provides a B2B SaaS platform for conversation management, customer support workflows, workflow tools, and related operational functions, including a direct integration with the Meta WhatsApp Business Platform.
The service is an independent business solution. It is not emergency communications infrastructure, and it should not be relied on as a substitute for emergency calling, dispatch, or legally specialized systems unless separately agreed in writing.
4. Accounts, security, and access control
- You are responsible for all activity that occurs under your account and for restricting access to authorized personnel only.
- You must protect credentials, devices, backups, and connected systems against unauthorized access.
- You must notify us promptly if you suspect misuse, compromise, or unauthorized access affecting your account or the service.
- We may require verification steps, administrative information, or security actions to protect the service or investigate abuse.
5. Pricing and payment
Paid plans, usage charges, third-party platform charges, and billing terms will be presented through the applicable order, invoice, plan page, or checkout flow. You are responsible for paying agreed fees and any applicable taxes, bank charges, or carrier charges unless the law requires otherwise.
Unless we state otherwise in writing, fees already accrued are non-refundable and unpaid amounts may lead to suspension or restriction of service access.
6. Acceptable use policy
- You may use the service only for lawful, authorized, and business-related communications.
- You may not use the service for spam, harassment, deception, impersonation, fraud, intimidation, unlawful surveillance, or misleading commercial practices.
- You may not upload or distribute content that is illegal, infringing, defamatory, hateful, sexually explicit, exploitative, or otherwise prohibited by law or platform policy.
- You may not interfere with the service, attempt unauthorized access, reverse engineer protected functionality, or use the service to harm other users, customers, or third parties.
7. Merchant responsibilities and Meta compliance
Because Wesal uses a direct Meta WhatsApp Business Platform setup, you must comply with Meta and WhatsApp technical documentation, business messaging rules, template rules, commerce restrictions, and applicable law.
Users of Wesal must comply with the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy. Violations may result in account restriction, suspension, or termination.
- You must maintain accurate business identity and public support contact details.
- You remain responsible for merchant opt-in compliance, the accuracy of template content, and the lawfulness of customer contact lists uploaded to the platform.
- You may contact people on WhatsApp only when you have the required phone number and lawful permission or opt-in.
- Outside the applicable customer service window, you may initiate messages only with approved message templates and for their approved purpose.
- You must honor block, unsubscribe, and opt-out requests and stop contacting people when required.
- You must provide clear escalation paths for customer support, including public contact channels such as email and phone or WhatsApp support.
8. Customer data and privacy obligations
You remain responsible for the personal data, content, contact lists, consents, notices, and instructions that you provide to or through the service.
You must ensure that you have all rights, permissions, and lawful grounds needed to collect, use, share, and message people through the service. You must also maintain your own privacy notices where required and respond to end-user rights requests when the law assigns those obligations to you.
9. Intellectual property
We and our licensors retain all rights, title, and interest in Wesal, including software, workflows, branding elements, content, documentation, and related intellectual property, except for the rights you own in your own materials.
Subject to these Terms, we grant you a limited, non-exclusive, revocable, non-transferable right to use the service for your internal business purposes. You may not copy, resell, sublicense, or exploit the service beyond that scope without written permission.
10. Third-party services and platform dependencies
The service may depend on or connect with third-party providers, including Meta, WhatsApp, hosting providers, payment providers, and other infrastructure or communications services. Those providers operate under their own terms, policies, service levels, and technical constraints.
We are not responsible for outages, policy actions, suspensions, pricing changes, or functionality limits imposed by third-party providers, although we may work with you in good faith to address issues where possible.
11. Service availability and limitations
We may modify, improve, replace, restrict, or discontinue features of the service from time to time. We may also suspend or limit access if needed for maintenance, security, legal compliance, payment default, abusive behavior, or platform-risk management.
We may remove or disable content, workflows, or access where we reasonably believe there is a violation of these Terms, applicable law, or platform policy.
12. Warranties disclaimer
To the maximum extent permitted by applicable law, the service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, error-free performance, or that the service will meet every business, regulatory, or platform-specific requirement of every user.
13. Responsibility and indemnity
You are responsible for your business content, customer communications, campaign choices, consent records, regulatory compliance, and use of the service. To the extent permitted by law, you will be responsible for claims, losses, or costs arising from your unlawful use of the service, your violation of these Terms, or your infringement of third-party rights.
14. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities arising from or relating to the service.
Where liability cannot be excluded, our total liability will be limited to the amount you paid us for the service giving rise to the claim during the twelve months before the event, unless applicable law requires a different result.
15. Termination
You may stop using the service at any time. We may suspend or terminate access if you breach these Terms, create legal or platform risk, fail to pay fees, or use the service in a way that threatens customers, third parties, or the integrity of the service.
After termination, provisions that by nature should survive will continue to apply, including provisions relating to payment, liability limits, intellectual property, compliance, and dispute-related record retention.
16. Governing law, disputes, and changes
These Terms are governed by the laws of Yemen, without regard to conflict of law principles. The parties will attempt to resolve disputes in good faith through direct written notice before pursuing court proceedings or other remedies available under applicable law.
We may update these Terms from time to time to reflect service, legal, operational, or platform changes. The updated version becomes effective when posted on this page, unless a later effective date is stated.
